Sovereignty of the People
Article 1 of the Constitution establishes a fundamental democratic principle: all sovereign authority belongs to the people of Kenya. This means that the citizens are the ultimate source of governmental power. However, because the entire population cannot directly manage all functions of government on a daily basis, the Constitution provides mechanisms through which this authority is exercised.
Under Article 1(3), the people delegate certain responsibilities to state institutions, including Parliament, the Executive, and the Judiciary, which act on behalf of the citizens. These institutions therefore hold power in trust and are expected to use it in a manner that serves the public interest and reflects the will of the people.
